General Terms and Conditions
effective from 22. 09. 2025
1. Introductory Provisions
General terms and conditions, hereinafter referred to as conditions, of ADRIA DATABANKA s.r.o., apply to all tourism services, hereinafter referred to as services, provided by travel agency ADRIA DATABANKA s.r.o., IČ: 26939207, with registered office in Brno, Panská 397/2, PSČ 602 00, Czech Republic, registered with the Regional Court in Brno, section C, file 46479, hereinafter referred to as CA and form an inseparable part of the contract for the provision of tourism services, hereinafter referred to as contract, concluded between the customer and CA.
A customer of CA may be either a natural person or a legal entity, in whose favor the contract with CA was concluded.
The contractual relationship between the customer and CA arises on the basis of the concluded contract. The legal relationship between the customer and CA is governed by the provisions of Act No. 159/1999 Sb., on certain conditions of doing business in the field of tourism, in its current wording, Act No. 89/2012 Sb., Civil Code, in its current wording, the contract and these conditions. The contract may be concluded directly with CA or with its external seller, who is authorized to do so on the basis of a mandate contract concluded with CA and granted power of attorney, about which the customer has the right to verify upon request from the external seller.
Important: Persons under 15 years of age may participate in CA services only on the condition that they are accompanied by a person over 18 years of age and with the consent of their legal representative. Persons aged 15 to 18 years may participate in CA services only with the consent of their legal representative.
2. Formation of Contractual Relationship and Conclusion of Contract
2.1 Contractual Relationship
The contractual relationship between the customer and CA arises on the basis of a Contract for the Provision of Tourism Services (hereinafter referred to as "contract") concluded by the customer (or their authorized representative) with CA (or its authorized seller) and on the basis of payment of a deposit to CA's account. In case the customer does not pay CA the amount specified in the Payment Request within the deadline specified in the Payment Request or does not deliver the contract proposal signed by them to CA within this deadline, CA considers that the customer is no longer interested in the relevant services and the relevant services will no longer be reserved for the customer.
2.2 Conclusion of Contract
The contract proposal is presented to the customer by CA or its external seller. After signing the contract proposal by the customer, the customer sends it to CA in one copy, either by mail or scanned by email.
The customer also confirms by concluding the contract that they are familiar with all characteristics of the provided services according to CA's offer (including photographs, published on CA's pages). By concluding the contract with CA, the customer also confirms, and this also for persons who are to use the agreed services with them, that they are not aware of any restrictions, whether health or other, that would prevent participants from participating in the agreed services, or that would require special care during the use of services, or that the customer should inform CA about.
By concluding the contract, the customer confirms that they know the content of the contract and that they agree with these general conditions, which are attached to the email with the contract and are published on CA's pages. The content of the concluded contract is determined by the contract, further by these conditions, the content of the offer of agreed services on CA's website, or special conditions for specific services, which are attached to the contract as an inseparable part.
If the Contract for the Provision of Tourism Services contains conditions different from the provisions of these general conditions or other conditions, specified in the previous paragraphs, the deviating agreements in such contract take precedence.
3. Price and Payment for Services
Services included in the price are listed on the website in the price list of accommodation facility services. The price of stay includes accommodation. Additional services are included in the price of stay only if this is explicitly stated in the contract. Fees not included in the price of stay must be paid by the customer on-site to the accommodation provider. In some facilities that CA offers, the price of the accommodation tax is already included in the accommodation price. In other facilities, it is necessary to pay the accommodation tax separately only at the accommodation location upon arrival. This information is always clearly stated at the relevant offer on CA's website in the service price list (supplementary price list in EUR). In case of non-compliance with the payment deadline of the Deposit Payment Request or payment of the deposit in an amount lower than specified in the Deposit Payment Request, the contract will not be concluded and in case that based on the Service Price Supplement Payment Request the service price was not supplemented in the required deadline or the supplement was paid in a lower amount, CA may withdraw from the contract.
4. Payment Terms
The customer undertakes to pay CA a deposit for payment of service prices in the amount specified at the end of the facility description in the Payment Method section of this house within the deadline specified in the Payment Request, and this after presenting the contract proposal and Payment Request. The deposit for payment of services is calculated from the total price. The customer will pay the price supplement on-site to the facility owner in Croatia, Slovenia or Italy in euros. This amount will be specified in the reservation confirmation, which they will receive from us after paying the deposit. When booking a stay in facilities where it is necessary to pay our CA the total amount for the stay, 50% of the stay price must be paid. The remaining 50% of the price must be paid no later than 45 days before the arrival date. If the customer will order a stay within a period shorter than 45 days before departure, 100% of the stay price will be charged. After receiving the payment and contract signed by the customer, CA will confirm contract acceptance by email. The customer is obliged to make payments under the variable symbol specified in the Payment Request.
If services are sold by CA's external seller, this deposit may also be paid through this external seller. The customer's right to provision of CA services arises upon payment of the full price of services. If the customer fails to fulfill this obligation, CA is entitled to withdraw from the contract. In such case, CA has the right to compensation and withdrawal fee according to these conditions see art. 11 of this contract.
5. Rights and Obligations of CA
5.1 CA is entitled in particular to:
- a. under conditions specified in these conditions change the conditions of agreed services;
- b. under conditions specified in these conditions withdraw from the contract;
- c. not provide financial compensation in case the customer does not use the agreed services due to their own fault.
5.2 CA is obliged in particular to:
- a. provide services to the customer according to the agreed contract properly;
- b. inform the customer about all changes in the provided services;
- c. after payment of the deposit or total price (in case the client pays 100% of the price to our CA) for services specified in the contract provide the customer by mail or email with all information and materials necessary for using the agreed services, namely:
i. Reservation Confirmation, with which the customer identifies themselves at the place of service use, with the following data:
- customer's first and last name;
- number of adults and separately number of children according to age categories;
- arrival and departure date;
- facility name according to server www.adriadatabanka.com and facility name at the location;
- facility owner's name, or name of partner agency;
- telephone contact with owner/responsible person, or with partner agency;
- facility address, or partner agency;
- specification of paid services, exact amount of supplement and overview of supplements.
ii. Travel Instructions – Itinerary, or information about purchased bus transport.
If the customer finds discrepancies in the above-mentioned instructions, they will inform CA about them.
6. Rights and Obligations of Customer
6.1 The customer has the right in particular to:
- a. proper provision of contractually secured and paid services;
- b. require from CA information that is known to CA and that relates to the agreed services;
- c. right to be informed about any changes in the agreed services;
- d. right to withdraw from the contract at any time before starting to use the services;
- e. right to complain about service defects and their handling in accordance with applicable legal regulations and these conditions;
- f. right to protection of personal data and information about travel purposes, which are the content of the contract, from unauthorized persons.
6.2 The customer is obliged in particular to:
- a. provide CA with cooperation that is necessary for proper securing and provision of services, above all truthfully and completely state CA's required data in the contract, including any changes to such data and present materials to CA according to their requirements;
- b. ensure for persons under 15 years of age accompaniment and supervision by an adult participant, similarly ensure accompaniment and supervision for persons whose health condition requires it;
- c. have consent of the legal representative in case a customer over 15 years and under 18 years uses services without their accompaniment and supervision;
- d. report accompanying children even in case they do not cover costs for their stay;
- e. report any change in the participant specified in the contract;
- f. pay CA the agreed price for services according to the contract;
- g. check whether all paid services are listed in the Reservation Confirmation;
- h. upon arrival at the accommodation location present to the facility owner or person authorized by them, or partner agency employee for inspection the Reservation Confirmation and pay supplements listed therein based on the contract;
- i. take over from CA documents necessary for using services and appear at the specified time at the place of service commencement with all required documents;
- j. behave in such a way that no damage to health or property occurs to the detriment of other customers or service providers, and if they cause damage, remove it at their own cost;
- k. respect customs and foreign exchange regulations of states to which the customer travels;
- l. ensure valid travel documents, including visas and other requirements necessary for departure to a specific destination (e.g., medical certificates, vaccinations, etc.). More detailed information can be found on the pages of the Ministry of Foreign Affairs of the Czech Republic, (www.mzv.cz);
- m. follow CA's information materials that specify service usage conditions;
- n. ensure timely and proper assertion of any claims against CA or service providers according to these conditions, in case of any defects during service use immediately inform CA by phone according to the procedure under art. 12 of these conditions;
- o. in case of customer's withdrawal from the contract inform CA of this withdrawal in writing and pay the withdrawal fee according to these conditions, if CA's right to it arose.
7. Accommodation
Accommodation is basically secured only for the number of persons agreed in the contract and listed in the Reservation Confirmation. If the customer wants to accommodate more persons or animals in the facility contrary to the concluded contract, the facility owner or person authorized by them is entitled to refuse additional persons and animals or accommodate them in the facility for a supplement.
8. Arrival and Departure
Customer's arrival at the accommodation facility should take place between 14:00 and 18:00 (unless otherwise stated in the reservation confirmation) on the day of service commencement. On the day of service completion, the customer leaves the accommodation facility by 10:00.
If the customer were to arrive after 18:00, it is necessary to inform the facility owner, person authorized by them or partner agency in advance (contact listed in the Reservation Confirmation), or CA employee. If the customer does not arrive at the accommodation location on the day of service commencement and does not announce later arrival by 18:00 of the same day to the facility owner or authorized person (on phones listed in the reservation confirmation or itinerary) or CA (on Help Line phone number), it is considered that the client is not interested in accommodation and withdraws from the contract.
9. Contract Terms Change
If it is necessary for objective reasons to change contract terms before starting to use services, CA may propose a contract change to the customer. If the proposed contract change leads to a change in service prices, the new price must be specified in the proposal. If CA proposes a contract change, the customer has the right to decide whether to withdraw from the contract or not. If the customer does not withdraw from the contract within the deadline set by CA, which may not be shorter than 5 days from delivery of the contract change proposal, and does not deliver this withdrawal to CA, it is considered that they agree with the contract change.
Before starting to use services, the customer may inform CA in writing that instead of them, another person listed in the notification will participate in the agreed services. On the day of delivery of this notification to CA, the person listed in the notification becomes CA's customer. The notification must contain a declaration by the new customer that they agree with the concluded contract. The original and new customer are jointly and severally liable for payment of the agreed services.
In case the customer wants to make a change in ordered services (change of date, number of persons, payment method, etc.), they must inform CA of this intention in writing or by email. For each service change after issuing the payment request, the customer is obliged to pay CA a handling fee of 40,- EUR (applies to changes made at least 30 days before arrival), changes 29 days to 1 day before arrival are for a fee of 80,- EUR. One service change is also considered multiple service changes (e.g., change of date and number of persons) made by one service change request. Service change is considered agreed only in case CA confirms the change to the customer in writing or by email and the customer pays the handling fee for the change (if the customer is obliged to pay this handling fee).
In case the change of ordered services represents an increase in service prices, the change is considered confirmed at the moment when upon CA's request the customer pays the price difference. CA will inform the customer about whether the service change results in a price change. If a new contract is concluded, payments made based on the original contract are considered payments according to the new contract.
Reduction in the number of ordered accommodation units or facility change or moving the entire period to another is considered withdrawal from the contract.
10. Withdrawal from Contract
10.1 CA may withdraw from the concluded contract with the customer:
- a. for reasons of termination of the possibility to provide ordered services for objective reasons. In case of service cancellation by CA for objective reasons, CA may be released from liability for damage to the customer due to service cancellation only in case the service cancellation occurred as a result of an unavoidable event that CA could not prevent, even with all effort that can be required from CA.
- b. due to contract breach by the customer. If CA withdraws from the contract before the customer starts using services due to customer's obligation breach, the customer is obliged to pay CA the further specified withdrawal fee listed in art. 11 of these conditions. The difference between the amount that CA received from the client for the relevant services and this withdrawal fee will be returned to the customer.
10.2 The customer may withdraw from the concluded contract at any time under conditions specified in the contract or under the following conditions:
- a. does not agree with the service change proposed by CA for objective reasons. If the customer withdraws from the contract because they do not agree with the service change proposed by CA for objective reasons, the customer has the right to require that CA offer them on the basis of a new contract other services in quality corresponding to the original contract, if CA has the possibility to offer such services to the customer. If such a new contract is not concluded, CA is obliged to return to the customer the entire amount they paid to CA;
- b. due to CA's obligation breach. If the customer withdraws from the contract due to CA's obligation breach specified in the contract or Act No. 159/1999 Sb., CA is obliged to return to the customer the entire amount they paid to CA. The customer's right to compensation is not affected by this;
- c. for any other reasons or without stating a reason. If the customer withdraws from the contract in other cases, they are obliged to pay CA the specified withdrawal fee according to art. 11 of these conditions.
Withdrawal from the contract by the customer or CA must be made in writing by letter or email, and is effective upon delivery to the other party.
11. Withdrawal Fee
In case of withdrawal from the contract by the customer or CA for reasons of customer's obligation breach, the customer has an obligation according to these conditions to pay CA a withdrawal fee. This withdrawal fee, for which calculation the day on which written withdrawal from the contract was delivered to the other participant is decisive, is specified in the following amount:
11.1 basic withdrawal fee for services and accommodation, if not specified otherwise in the following points or by email before contract conclusion:
- a. withdrawal from contract from contract signing to 90 days before service commencement 20% of total contract price, at least however 60,- EUR;
- b. withdrawal from contract 89 – 60 days before service commencement 30% of total contract price;
- c. withdrawal from contract 59 – 30 days before service commencement 50% of total contract price;
- d. withdrawal from contract 29 – 14 days before service commencement 75% of total contract price;
- e. withdrawal from contract 13 to 0 days before service commencement or non-arrival for stay 100% of total contract price.

- a. withdrawal from contract from contract signing to 45 days before service commencement: 30% of total contract price, at least however 60,- EUR;
- b. withdrawal from contract 44 – 20 days before service commencement: 75% of total contract price;

- d. withdrawal from contract 25 – 13 days before service commencement: 75% of total contract price;

- a. withdrawal from contract from contract signing to 13 days before service commencement: 100% of price for four nights stay according to price in payment request and contract, at least however 60,- EUR;
- b. withdrawal from contract 12 to 0 days before service commencement or non-arrival for stay: 100% of total price for six nights according to payment request and contract.

- a. withdrawal from contract from contract signing to 63 days before service commencement: 40% of total contract price, at least however 60,- EUR;
- b. withdrawal from contract 62 – 49 days before service commencement: 50% of total contract price;
- c. withdrawal from contract 48 – 36 days before service commencement: 65% of total contract price;
- d. withdrawal from contract 35 to 0 days before service commencement or non-arrival for stay: 100% of total contract price.

- d. withdrawal from contract 27 – 20 days before service commencement: 80% of total contract price;
- e. withdrawal from contract 19 to 0 days before service commencement or non-arrival for stay: 100% of total contract price.

- b. withdrawal from contract 34 – 27 days before service commencement: 40% of total contract price;
- c. withdrawal from contract 26 – 19 days before service commencement: 50% of total contract price;
- d. withdrawal from contract 18 – 13 days before service commencement: 80% of total contract price;
- e. withdrawal from contract 12 to 0 days before service commencement or non-arrival for stay: 100% of total contract price.
11.18 If the customer does not receive by email before contract conclusion other withdrawal fee conditions, applies in case of services, the part of which is accommodation in private apartments and houses with the following code: 549/P/…
- a. withdrawal from contract from contract signing to 35 days before service commencement: 25% of total contract price, at least however 60,- EUR;
- b. withdrawal from contract 34 – 27 days before service commencement: 40% of total contract price;
- c. withdrawal from contract 26 – 20 days before service commencement: 50% of total contract price;
- d. withdrawal from contract 19 – 13 days before service commencement: 80% of total contract price;
- e. withdrawal from contract 12 to 0 days before service commencement or non-arrival for stay: 100% of total contract price.
11.19 In case of services, the part of which is accommodation in hotels, campsites and resorts with the following code: 549/…, 549/H…, 549/K…, 549/R…
- a. withdrawal from contract from contract signing to 30 days before service commencement: 25% of total contract price, at least however 60,- EUR;
- b. withdrawal from contract 29 – 20 days before service commencement: 50% of total contract price;
- c. withdrawal from contract 19 – 13 days before service commencement: 80% of total contract price;
- d. withdrawal from contract 12 to 0 days before service commencement or non-arrival for stay: 100% of total contract price.
11.20 In case of services, the part of which is accommodation in luxury villas, holiday houses and independent houses with the following code: 549/…, 549/LV/…, 549/PD/…
- a. withdrawal from contract from contract signing to 66 days before service commencement: 20% of total contract price, at least however 60,- EUR;
- b. withdrawal from contract 65 to 0 days before service commencement or non-arrival for stay: 100% of total contract price.
11.21 In case of services, the part of which is accommodation in facilities (except villas and houses with pool) with the following code: 2561/...
- a. withdrawal from contract from contract signing to 65 days before service commencement: 25% of total contract price, at least however 60,- EUR;
- b. withdrawal from contract 64 – 19 days before service commencement: 40% of total contract price;
- c. withdrawal from contract 18 – 13 days before service commencement: 80% of total contract price;
- d. withdrawal from contract 12 to 0 days before service commencement or non-arrival for stay: 100% of total contract price.
11.22 In case of services, the part of which is accommodation in villas and houses with pool with the following code: 2561/…
- a. withdrawal from contract from contract signing to 95 days before service commencement: 25% of total contract price, at least however 60,- EUR;
- b. withdrawal from contract 94 – 65 days before service commencement: 40% of total contract price;
- c. withdrawal from contract 64 – 35 days before service commencement: 60% of total contract price;
- d. withdrawal from contract 34 to 0 days before service commencement or non-arrival for stay: 100% of total contract price.
11.23 Paper, benefit and electronic vouchers
Paper, benefit and electronic vouchers are not exchangeable for money. When canceling a stay that was partially paid with vouchers, CA does not return vouchers or financial amounts for vouchers. The amount paid with vouchers will be primarily used to pay cancellation fees. If after paying cancellation fees an overpayment arises, the customer may use this overpayment to pay for another service that will be provided until the end of the current calendar year.
12. Service Complaints
In case of any defects in the provided services or when damage arises to the customer related to service use, it is necessary for the customer to point out these defects to the facility owner or person authorized by them (listed in the Reservation Confirmation) without undue delay and possibly draw up a complaint protocol. If the owner or person authorized by them does not remedy, the customer is obliged to immediately inform CA by phone about the arisen situation. CA will take appropriate steps to remedy, or secure substitute accommodation in the nearest corresponding facility.
Only direct pointing out of defects in the provided services can lead to their removal. Time delay in complaint assertion makes it difficult to prove and objectively assess, and thus the possibility of its proper handling. In case CA does not properly and timely fulfill its obligations towards the customer according to the concluded contract or Act No. 159/1999 Sb., the customer may assert their rights arising from this at CA without undue delay, at the latest however within one month from service completion, respectively in case services were not realized, within one month from the day when services according to the contract were to end, otherwise these customer rights expire.
If service provision is mediated by an external seller, the monthly deadline according to the previous paragraph is preserved also in case the customer complained at this external seller within the deadline.
CA may be released from liability for damage caused by breach of legal obligation, if it proves that such damage was not caused by CA itself, nor by other CA contractual tourism service providers within the agreed services and the damage was caused by:
- a. the customer;
- b. a third person who did not participate on the basis of previous agreement with CA in service provision;
- c. an event that CA could not prevent even with the effort that can be required from it.
According to regulation No. 378/2015 Sb. the customer in case of non-resolution of complaint with CA has the right to submit a proposal to an entity of out-of-court consumer dispute resolution:

13. Additional Agreements
- a. Evening entertainment, restaurants, bars, etc., which may cause noise, are also part of the holiday. This noise however does not reduce the quality of provided services and cannot be subject to complaint.
- b. The travel agency is not responsible for possible beach or sea pollution.
- c. Due to climatic conditions, insects may occur in accommodation facility premises. If this situation occurs, it is necessary to resolve it immediately with the owner or inform CA employees about it.
- d. clients are obliged to observe house rules and night quiet, if they do not observe them, the owner may evict them from the apartment without compensation. CA in this case bears no responsibility towards clients.
- e. The travel agency is not responsible for the possibility of entry and swimming of domestic pets on the beach, it only provides accommodation for domestic pets in apartments where this is stated on the website.
- f. When using air conditioning, the client agrees to follow the instructions of the facility owner, responsible person or partner agency employee. Air conditioning may only be turned on during the time clients are present in the unit, during air conditioning use it is not allowed to open windows and doors.
14. Special Provisions
CA cares for personal data protection in accordance with applicable and effective legislation, which from 25. 5. 2018 is represented primarily by EU Regulation 2016/679 (General Data Protection Regulation, abbreviated "GDPR"), which is in the Czech Republic supplemented by the accompanying law on personal data processing. When providing our services, we process in the position of controller your personal data provided by you in the scope necessary to fulfill our contractual and legal obligations. In the scope necessary for protection of our rights and legal claims, we will process these your personal data in an appropriate manner also on the basis of so-called legitimate interest.

16. Final Provisions
These conditions enter into force and effect on 22. 09. 2025, whereby on this day the previous conditions lose their validity.
